SCOTUS: No Cert for Murphy Co. v. Biden

This week the United States Supreme Court did not grant certiorari to the Timber company plaintiff Murphy Co. which was suing the Biden administration’s expansive interpretation of the Antiquities Act to block timber harvests on federal land in Oregon. Justices Gorsuch and Kavanaugh supported granting the petitions, but that was not enough. So the lower court’s ruling in favor of the Biden administration’s defense of the Obama administration’s Proclamation 9564, 82 Fed. Reg. 6,145 (Jan. 12, 2017) blocking Oregon timer harvests will remain in place.
