Man serving life for killing baby son has murder conviction overturned

The Oregon Court of Appeals on Wednesday overturned the conviction of a Tigard-area man serving a life sentence for the June 2011 death of his 11-week-old son.

Evidence found during a search of computers belonging to Kaliq Mansor should have been suppressed because the search warrant authorizing the examination was too broad, the appeals court found.

Mansor's internet history showed his Google searches included "newborn abuse," "Oregon child abuse laws," "father hates infant," "afraid of abusing my baby" and other similar search terms up to three days before he called 911 to report his son, Bryan, wasn't breathing, prosecutors said.

Mansor, 38, was sentenced to life in prison in October 2012 for murder, murder by abuse, first- and third-degree assault and first-degree criminal mistreatment. The charges alleged abuse of the baby and his surviving twin brother.

Mansor was ordered to serve 28 years before being eligible for parole. Washington County Deputy District Attorney Roger Hanlon didn't immediately respond to a request for comment on whether his office will appeal or retry the case.

The boy died two days after being taken to a hospital. Doctors determined he was brain dead with a fractured skull, a rib fracture, several retinal hemorrhages and other injuries. His twin also had retinal hemorrhaging and a broken rib.

Angela Foster, the children's mother and Mansor's ex-wife, said she disagrees with the appeals court's decision. Her surviving son will be starting kindergarten.

"I'm completely heartbroken and saddened by today's ruling," Foster said. "I hope that in the end justice will prevail and that Mr. Mansor will remain in prison, where he belongs, for the rest of his life."
