State land use board overturns Portland fossil fuels ordinance

PORTLAND, Ore. — Oregon's land use board has overturned Portland's fossil fuels ordinance, and the city is now considering an appeal.

The ordinance barred the expansion of infrastructure used to store or transport oil and gas.

The Land Use Board of Appeals ruled Wednesday the legislation violates the U.S. Constitution's Commerce Clause.

Mayor Ted Wheeler reacted, saying in a statement, "This decision is disappointing. The City is reviewing the ruling and exploring our options, including an appeal."
